Description:

Canada reserves the right to adopt or maintain measures that could result in different passenger rail transportation service levels between regions of Canada based on such factors as passenger demand and the need to provide service to remote communities.

In order to ensure the integrated and competitive operation of the national freight rail transportation system, Canada may adopt or maintain measures relating to freight rail transportation services.

Description:

Description:

Measures relating to aviation or air transport, or related services in support of aviation or air transport, are not subject to this Agreement. Notwithstanding the foregoing, Canada’s measures relating to aviation or air transport, or related services in support of aviation or air transport, are subject to Article 203 (Transparency) and Article 402 (Regulatory Notification).

Notwithstanding the foregoing, Chapter Five (Government Procurement) is applicable to measures regarding the procurement of aviation goods and services by a procuring entity.

Description:

Canada reserves the right to adopt or maintain any measure that is part of a general framework of regional economic development, provided that:

  1. the measure does not operate to impair unduly the access of persons, goods, services, or investments of another Party; and
  2. the measure is not more trade restrictive than necessary to achieve its specific objective.

For the purposes of this exception, “general framework of regional economic development” means a program or statute-based system that:

  1. specifies eligibility criteria or development priorities based on, but not limited to, such factors as geographic area, sector or population group;
  2. is generally available to recipients that meet the eligibility criteria; and
  3. identifies reasonable performance or economic development objectives or targets that can be measured.
